2. Legal Regulations for Vietnamese Buyers

To maintain domestic housing market stability, Australian law enforces clear and strict rules for foreign buyers. 

2.1 Requirements for Temporary Residents and Non-PR Buyers  

Vietnamese citizens who do not hold Australian Permanent Residency (PR) or citizenship, including students on temporary visas (such as the Subclass 500 Visa) or temporary workers, must obtain approval from the Foreign Investment Review Board (FIRB) before completing any property transaction. 

2.2 Eligible Property Types (Latest Updates)  

The Australian Government strictly regulates the types of residential property foreign buyers can acquire: 

  • Allowed: Brand-new residential properties that have never been occupied, off-the-plan builds currently under construction, or vacant land for development (provided construction is completed within 4 years). There is no limit on the number of new properties a foreign investor can purchase. 
  • Prohibited: Established (second-hand) dwellings. Foreign non-residents are strictly prohibited from purchasing established homes as investment properties or rentals. 
  • Exception for Temporary Visa Holders: Individuals holding a valid visa for more than 12 months may buy one established home to live in but must sell it within three months of departure or visa expiry. 
  • Please note: FIRB fees for established homes are substantially higher than for new dwellings, starting from AUD 45,300 versus AUD 15,100 for properties under AUD 1 million. Foreign owners may incur an annual Vacancy Fee if they are not in the household for more than 183 days per year. 

3.  Foreign Surcharges and Financing

Before purchasing property in Australia, foreign buyers should understand the state taxes, surcharges and financing requirements that may apply. 

3.1 Foreign Purchaser Surcharges   

Stamp duty and property transaction surcharges in Australia are administered by individual state governments rather than the federal government. Taxes therefore vary depending on the property's location: 

  • Mechanism: Foreign individuals or entities buying residential real estate must pay a Foreign Purchaser Surcharge on top of the standard state stamp duty (3% to 5.5%). 
  • Annual Absentee Land Tax Surcharge: Beyond initial purchase taxes, foreign investors should budget for annual land tax surcharges if the taxable land value exceeds state thresholds (e.g., currently 4% in Victoria and 4% in New South Wales). 

Current surcharge rates are as follows:  

  • New South Wales (NSW): 9% of the property's dutiable value; 
  • Victoria (VIC): 8%; 
  • Queensland (QLD): 8%; 
  • Tasmania (TAS): 8%; 
  • Western Australia (WA): 7%; 
  • South Australia (SA): 7%; 
  • Australian Capital Territory (ACT): No foreign purchaser surcharge applies; 
  • Northern Territory (NT): No foreign purchaser surcharge applies.  

 

3.2 Financing Rules

The Australian financial system allows non-PR buyers to access mortgage financing, though lending limits and underwriting standards remain stringent: 

  • Loan-to-Value Ratio (LVR): For foreign borrowers without AUD-denominated income, the four major Australian banks and non-bank lenders generally cap the LVR at 60-70% of the property valuation. Buyers must cover the remaining 30-40% deposit, plus taxes and legal fees, using unencumbered funds. 
  • Interest & Verification: Foreign borrowers typically face interest rates 0.5-1.5% higher than domestic buyers or PR holders. The Foreign Income Verification process requires certified translations of bank statements, payslips, personal income tax returns from Vietnam, and formal credit reports. 

4. Step-by-step Purchase Process     

To safeguard your legal and financial interests, follow this standard purchase procedure: 

  • Choose an Eligible Property: Begin by identifying a property that complies with foreign ownership rules. For most overseas buyers, this will typically be a new apartment, townhouse or off-the-plan development approved for foreign purchase. 
  • Appoint a Solicitor: Property transactions in Australia require legal oversight. Your solicitor will review the sale contract, explain your obligations and, where appropriate, include safeguards such as a condition requiring FIRB approval before the purchase proceeds. 
  • Submit FIRB Application: Most foreign buyers must secure approval from the Foreign Investment Review Board (FIRB) before purchasing residential property. Your solicitor can assist with the application and payment of the applicable FIRB fee. 
  • Exchange Contracts and Pay Deposit: Once the terms of the purchase have been agreed, both parties sign the contract, and the buyer pays a deposit, typically around 10% of the purchase price. The funds are held in a regulated trust account until settlement. 
  • Arrange Financing and Complete Settlement: Before settlement, buyers should finalise financing arrangements and prepare the remaining balance of the purchase price. On settlement day, legal representatives complete the transaction, pay the required taxes and transfer ownership of the property to the buyer.
